RETURN AND PRODUCT QUALITY POLICY

PERISHABLE FOODS AND MEATS

Due to food-safety concerns, all sales of refrigerated, frozen and other perishable foods are final. We do not accept returns because of customer preference, improper transportation, improper storage, improper handling or improper preparation after purchase.

If a customer believes a product was defective, spoiled or otherwise unfit when purchased, the concern must be reported promptly. The customer must retain and return the remaining product, the original packaging and the original receipt or other proof of purchase. The product must be kept refrigerated or frozen, as appropriate, until it is returned to the store.


PRODUCT QUALITY COMPLAINTS

To evaluate a complaint and, when appropriate, report it to the distributor or manufacturer, Mitchell's Market may require the product UPC, expiration or best-by date, lot or production code, and any identifying store mark placed on the package. Refunds or replacements will not be issued based solely on a telephone complaint when the product and packaging are unavailable for inspection.

Mitchell's Market may photograph, inspect and retain the returned product and packaging. Serious concerns involving illness, foreign material, damaged seals, swollen packaging or other possible food-safety issues will be referred to management immediately.


NON-PERISHABLE FOODS

Non-perishable food items may be considered for return only when the original receipt is presented and the packaging is unopened, unused and in resalable condition. Opened products are not returnable unless management determines that the item is defective.


SPECIAL ORDER ITEMS

All special order item sales are final and are not eligible for return, refund or exchange unless management determines that the item was defective when sold.


PROOF OF PURCHASE AND IDENTIFICATION

The original receipt or other acceptable proof of purchase is required for all refund, replacement or exchange requests. When an identifying store mark, date code, numbered sticker or other store-applied code is used, the returned package must bear that identifying mark.


MITCHELL'S MARKET RESERVES THE RIGHT TO APPROVE OR DENY ANY RETURN, REFUND, REPLACEMENT OR EXCHANGE.
